Special Terms and Conditions for healthcare professionals – doctors and nursing staff (Terms for healthcare professionals)

This is a translation for convenience. In the event of any discrepancy, the German version of this text is the legally binding one.
1. Scope
1.1 These Special Terms and Conditions (“Terms for healthcare professionals”) apply to doctors and nursing professionals (“healthcare professional”) who register with MedPool in order to be placed in permanent positions or fixed-term assignments (“locum assignments”). The General Terms apply in addition.
1.2 By registering, the healthcare professional gives MedPool a placement mandate within the meaning of Art. 8 AVG. These terms constitute the written placement agreement.
2. MedPool is not your employer
2.1 MedPool provides placement only. MedPool does not employ you – neither temporarily, nor for locum assignments, nor permanently – pays you no salary and gives you no instructions.
2.2 Your contractual partner for the assignment or the employment is always the clinic. You are free to decide whether to accept a proposal.
3. Costs
3.1 Placement is free of charge for healthcare professionals. MedPool charges neither a registration fee nor a placement commission. MedPool is paid exclusively by the clinics.
3.2 Fees charged by the paying agent for processing fees or salaries are governed solely by any separate contract between you and the paying agent and do not flow to MedPool.
4. No exclusivity
You may apply at any time through other agencies or directly to employers. You may deactivate your profile or terminate the placement mandate at any time.
5. Profile and availability
5.1 You keep your profile, your qualifications and your availability up to date.
5.2 Process on the platform: available → provisionally reserved (request from a clinic, limited response period depending on urgency) → confirmed (acceptance by both sides, followed by the assignment contract) → blocked. If the response period expires, the reservation is lifted.
5.3 An acceptance is binding. The assignment only comes into being with your confirmation and that of the clinic.
6. Evidence and warranties
6.1 Before the first assignment or before the contract is concluded, you provide the following and present the originals at the place of assignment on request:
- curriculum vitae with a complete professional record;
- diplomas, specialist titles or nursing diploma as well as their recognition in Switzerland (MEBEKO or Swiss Red Cross);
- register entry MedReg or NAREG and, where required, the cantonal professional practice licence;
- identity document and, where required, residence and work permit;
- a current private extract from the criminal record (no more than three months old);
- for option A: evidence of recognition as self-employed for old-age and survivors’ insurance purposes, or a valid A1 form.
6.2 You warrant that there are no professional bans, restrictions on professional practice or pending regulatory proceedings, and you inform MedPool without delay of any change.
7. Your status in locum assignments
7.1 Option A – self-employed: you carry out the assignment as a self-employed person under a mandate from the clinic (Art. 394 et seq. CO). You settle social insurance contributions and taxes yourself and carry your evidence with you during the assignment.
7.2 Option B – employed on a fixed-term basis by the clinic: if the evidence under section 6.1 no. 6 is missing or you are classified as an employee, you are an employee of the clinic for the duration of the assignment (Art. 319 et seq. CO). The clinic settles the social insurance contributions. Continued payment of salary exists only to the statutory extent; there is no remuneration between assignments.
7.3 The status is recorded in the assignment confirmation.
8. Remuneration for locum assignments
8.1 Doctors: standard, as per the assignment contract. Deviations are agreed in the assignment contract.
8.2 One assignment day comprises a maximum of 10 hours of attendance. Each further started quarter of an hour is remunerated at 25 % of the hourly fee.
8.3 Nursing professionals: remuneration as per the assignment contract.
8.4 Night, weekend and public holiday duties, accommodation, meals and travel expenses are governed by the assignment confirmation.
9. Time recording and payment
9.1 You record your attendance from the start of the assignment and have it countersigned by the responsible person at the clinic. You submit it monthly or after the end of the assignment via the platform.
9.2 Payment is made by Payroll Plus AG as paying agent in the name and for the account of the clinic. MedPool checks the documents only for completeness and makes no payments itself.
10. Obligations during the assignment
10.1 You observe the agreed duty hours as well as the professional, ethical and operational rules of the clinic. Professional and organisational management lies with the clinic, not with MedPool.
10.2 You use your own professional clothing unless the clinic provides it. Work equipment is provided by the clinic.
10.3 You maintain professional secrecy (Art. 321 of the Swiss Criminal Code) and patient confidentiality, including after the end of the assignment.
10.4 The clinic insures your activity under its business or professional liability insurance. Under option A, MedPool additionally recommends your own professional liability insurance.
11. Inability to attend, cancellation and non-appearance
11.1 If you are unable to start or continue a confirmed assignment for good cause (illness, accident, death in the family), you inform the clinic and MedPool immediately and subsequently provide evidence (e.g. a medical certificate). Your entitlement ends on the last assignment day worked, unless the law provides otherwise.
11.2 Option A: if you fail to attend a confirmed assignment without good cause or break it off at an inopportune time, you owe the clinic compensation (Art. 404 para. 2 CO); five daily fees apply as a guideline.
11.3 Option B: in the event of unjustified failure to start or abandonment of the position, Art. 337d CO applies.
12. Permanent positions
Where you are placed in a permanent position, you conclude the employment contract directly with the clinic. Any fees for this are paid exclusively by the clinic.
13. Data protection
13.1 You consent to MedPool processing your profile data, matching it with positions and assignments and showing clinics your profile for specific requests. Your full dossier is only passed to a clinic to which you have consented in the individual case.
13.2 The platform compiles shortlists partly automatically; the selection is always made by the clinic. You may request a human review and withdraw your consent at any time.
13.3 After your profile is deactivated, your data is deleted unless statutory retention obligations apply.
14. Termination
You and MedPool may terminate the placement mandate at any time. Assignments already confirmed remain unaffected.
15. Law and place of jurisdiction
Swiss law applies. For actions against MedPool, the courts at MedPool’s registered office or place of business as well as the statutory places of jurisdiction are available to you (Art. 34 of the Swiss Civil Procedure Code). For actions brought by MedPool, your place of residence applies.
